Create landscape lighting, billboard lighting, urban lighting such as greenery, sculpture, fountain lighting, and management of urban nightscapes.

Article 3 The urban management department of Shijiazhuang City is responsible for the implementation of these Measures. The Shijiazhuang Night Lighting Management Office and the urban management departments of each district are responsible for the specific work according to their respective division of labor.
The departments of planning, construction, public security, and gardening shall coordinate with the city management department to do their management work according to their respective responsibilities.

Article 4 The management of night lighting in cities adheres to the principles of unified planning, government support, and social participation, encourages social funds to participate in the construction of night lighting, and encourages the use of advanced materials, technologies, processes, and light sources for the construction and renovation of night lighting.

Article 5 Owners or managers of major roads, important public places, residential areas, industrial areas, bridges, river banks, etc. in urban areas shall install roads and municipal facilities lighting and neon in accordance with the requirements of night lighting and implementation plans. Night scenes such as lanterns, spotlights, and building outline lights. The municipal government arranges special funds for urban night lighting construction in urban construction funds, and subsidizes units and individuals investing in non-commercial night lighting projects.

Article 6 The urban management department shall organize the preparation of the urban night lighting plan according to the overall planning of the city, together with the planning, construction, gardening and other relevant departments, and report it to the urban construction plan after approval by the municipal government. The urban new construction, reconstruction, expansion project and the old city reconstruction project shall simultaneously design, synchronize and simultaneously put the night lighting construction project and the main project.

Article 7 The urban management department shall, in accordance with the urban construction plan and the national technical standards, formulate the project implementation plan according to the urban construction plan and the national technical standards for the construction of the night lighting project that is included in the urban night lighting plan, and report it to the municipal government for approval. The content of the implementation plan should include the road sections or geographical areas involved, setting technical requirements, lighting and beautifying standards, etc.

Article 8 The night lighting facilities invested by units or individuals shall be owned by investors. The investors shall enjoy the right to benefit and shall not arbitrarily modify, dismantle or change their functions.

Article 9 The urban management department shall participate in the design review of individual projects invested or constructed by the government or newly built, rebuilt or expanded projects attached to infrastructures such as roads and bridges.
The unit that undertakes the design and construction of the urban night lighting project must have the design qualification approved by the provincial construction administrative department and the qualification of the urban road lighting engineering professional contracting enterprise, and undertake the corresponding design and construction tasks according to the qualification level.

Article 10 The design and construction of night lighting shall be carried out in accordance with the requirements of night lighting planning and night lighting schemes, and the following provisions shall be observed:
(1) It shall not cause light pollution and affect residents' lives and health;
(2) It shall not affect the normal use of traffic lights and other important sign lights;
(3) It shall not affect the normal running of traffic trunk vehicles;
(4) It shall not affect the normal use functions of buildings (structures), urban greening, and public facilities;
(5) It shall not hinder the appearance of the city and the overall image of the city.

Article 11 After the completion of the night lighting project, the construction unit shall organize the inspection and acceptance, and notify the city management department to participate. Those who fail to pass the test or fail to pass the inspection shall not be delivered for use, and may not handle the handover management procedures.

Article 12 The night lighting facilities of the city invested and constructed by the government shall be maintained by the night lighting management unit after handling the handover management procedures.

Article 13 The urban night lighting facilities invested and constructed by units or individuals shall be maintained by the unit or individual or entrusted by the professional maintenance unit of night lighting. If it is necessary to hand over to the night lighting management agency for special circumstances, its facilities shall comply with the night lighting design, installation and construction quality standards, and shall provide the relevant qualification copies and drawings of the construction unit, and pay the operation and maintenance costs as required. The city management department shall organize the night lighting management organization, maintenance unit and construction unit to carry out the appraisal, and handle the handover procedures after passing the qualification.

Article 14 The municipal administrative department shall formulate the maintenance norms for the city's urban night lighting facilities in accordance with the relevant provisions of the state and the province. Units or individuals shall strictly implement them to ensure the safety and function of the facilities, and the lighting, patterns and texts are clear and complete, and the appearance is clean and tidy. . If the equipment does not meet the requirements, the maintenance unit shall promptly repair, clean and replace it.

Article 15 The property rights unit or management unit of the night lighting facilities shall ensure the lighting time and quality according to the relevant regulations. The night landscape lights shall be illuminated for no less than four hours at night. Special circumstances may be adjusted by the city management department. . During holidays and major events, they must obey the uniform requirements of the city management department.

Article 16 The safety distance between trees in the vicinity of urban night lighting facilities shall not be less than one meter away from charged objects. The safety distance of trees and night lighting facilities is not in compliance with the regulations, and the night garden lighting management agency landscaping management department promptly prunes.
Due to the force majeure, the trees endanger the safe operation of the city's night lighting facilities. The night lighting management agency can take emergency measures to pruning and felling while notifying the landscaping department.
If the lighting facilities are damaged and a large area is extinguished, the night lighting management agency may take emergency measures to repair it, and then go to the relevant departments to complete the relevant procedures.

Article 17 If the night lighting facilities of a city are damaged due to a traffic accident, the accident handling department shall promptly notify the night lighting management agency.

Article 18 If it is necessary to relocate, protect or dismantle or modify the urban night lighting facilities, it shall be agreed with the city management department or approved in accordance with relevant regulations, and shall be supervised by the night lighting management agency.

Article 19 If it is necessary to occupy the urban night lighting facilities invested and constructed by the government, it shall go through the occupation procedures of the night lighting management agency, and after being approved by the city management department, it shall be implemented by the night lighting management organization.

Article 20 No unit or individual may engage in the following acts without authorization:
(1) dismantling, moving or modifying the urban night lighting facilities;
(2) stacking objects and constructing structures (structures) within one meter of the street lamp poles and power distribution facilities;
(3) Hanging, posting publicity materials and setting advertisements on urban night lighting facilities;
(4) erecting lines, installing other facilities or accessing power sources in urban night lighting facilities;
(5) Other acts that encroach upon or affect the normal use of urban night lighting facilities.

Article 21 The municipal administrative department may entrust the night lighting management agency to impose administrative penalties for violations of these Measures.

Article 22 Anyone who commits one of the following acts in violation of these Measures shall be ordered to make corrections within a time limit, and if it is not corrected as required, it may be punished according to the following provisions:
(1) Refusing to implement the urban night lighting planning and implementation plan requires the construction and installation of night lighting facilities, and impose a fine of 1% to 5% of the investment amount;
(2) A fine of 2,000 to 5,000 yuan shall be imposed for the construction or installation of night lighting facilities that do not meet the prescribed schemes and standards;
(3) A fine of 500 yuan to 2,000 yuan shall be imposed if the night lighting facilities that have not been accepted or accepted for unqualified use are put into use without authorization;
(4) If there is no qualification or exceeds the qualification level, the design or construction of urban night lighting facilities shall be fined according to the design and construction cost of 1% to 5%.

Article 23 Anyone who commits one of the following acts in violation of these Measures shall be ordered to make corrections within a time limit, and if it is not corrected as required, it may be punished according to the following provisions:
(1) A fine of 200 yuan to 500 yuan shall be imposed if the time and quality of lighting are not guaranteed in accordance with the provisions of these Measures;
(2) If the maintenance obligation is not fulfilled as required, a fine of 500 yuan to 1,000 yuan shall be imposed;
(3) If the facility is defaced, worn out, the lighting is incomplete or the facilities are loose or falling off, and there is a potential safety hazard, a fine of 500 yuan to 1,000 yuan shall be imposed;
(4) Those who violate the provisions of Article 20 of these Measures and impose a fine of 500 yuan to 2,000 yuan, causing losses, shall be ordered to compensate for the losses.
If the night lighting management agency finds any violation of the provisions of Article 23 (2), (3) and (4), it may notify the responsible unit to rectify within the specified time. If it fails to rectify according to the regulations, it shall order the relevant facilities to be demolished within a time limit. If it is not dismantled within the time limit, the city management department may organize the dismantling, and the cost of dismantling shall be borne by the offender.

Article 24 These Measures shall come into force on December 23, 2004.
